These Terms of Use (this "Agreement"), between you as the user(s) of the website "www.getmymachine.com" (the "User(s)") and GetMy Machine Pvt. Ltd. (hereinafter referred to as "GMM") doing business as "www.getmymachine.com" (hereinafter referred to as "Website"), shall govern your use of and access to the Website (as defined below). By accepting this Agreement you agree to be bound by each of its terms, and you have read and understood GMM's Privacy Policy. GMM reserves its right to amend this Agreement from time to time.

The purpose of this Agreement is to state the terms and conditions under which, a user (you) can make use of the Website for purposes of locating capital equipment for purchase or selling capital equipment. GMM is merely a platform and not an Original Equipment Manufacturer, Dealer or Agent with respect to the products and services listed on the Website. GMM is an online resource for buyers to post their requirements and sellers to advertise their goods and to locate these buyers. GMM does not endorse or recommend any of the product or services listed on the website. The buyer is advised to use his own discretion to proceed about any engagement for the products and services listed on the website and directly purchase/deal with the Original Equipment Manufacturer, Dealer or Agent. GMM shall not be liable in any way for the product or any other action taken by any of these third party vendors. GMM shall not be liable for any loss, damages or costs arising in any way connected with your purchase and/or use of any machine, or service at the Website.

GMM expressly reserves the right to suspend, withdraw, or terminate the offering of one or all of its Services at any time.

USE

With the acceptance of this agreement you are hereby granted a non-transferable, non-exclusive, revocable, limited license to access and use the Website for the period as agreed. GMM reserves the right to update or modify the website, at its discretion. You are not permitted to sublicense or transfer any of your rights hereunder including, without limitation, access to the website or password-protected portions of the Website.

FEES

Fees charged for the various services offered at the Website. In consideration for providing the Services, you agree to pay all such fees which are due and owing on account of the selections you have made at the Website or through a GMM representative. Fees are payable as set forth in the quotation submitted to you, and you hereby agree to pay all costs and expenses incurred by GMM. You authorize GMM to charge the credit card you have on file with GMM for all Fees due and owing hereunder. All fees are non-refundable once paid.

TERM AND TERMINATION

GMM reserves the right to terminate access to certain areas or features of the website at any time for any reason, with or without notice. GMM also reserves the right to deny access to particular user(s) without any prior notice/explanation in order to protect the interests of GMM and/or other visitors to the web site.

GMM can terminate the user account for any of the following reasons:

(i) The user(s) breach any provisions of the terms and conditions of use agreement and/or Agreement of web site.
(ii) Any unauthorized access, use, modification, or control of the web site data base, network or related services.
(iii) if the user has shared his username and password to third party.
(iv) if it concludes that the user(s) have provided any false information in connection with the member account to GMM, or are engaged in fraudulent or illegal activities.
(v) Impersonate or unlawfully use another companies name to post information or conduct business of any form
(vi) Any other reason which is against the business interest of GMM.

If GMM terminates user(s) membership, user(s) will not have the right to re-enroll or join GMM under a new account or name unless formally invited to do so by GMM. In any case of termination, no membership charges will be refunded.

INTELLECTUAL PROPERTY

All trademarks, patents, copyrights and other intellectual property rights owned by either party on the date hereof shall continue to be owned solely by such party, and except as set forth herein, nothing in this Agreement shall be deemed to confer any rights to any such intellectual property on the other party.

GMM is the sole owner of the name "getmymachine.com" as well as the Website, all source code, object code, software, content, copyrights, trademarks, patents and other intellectual property related thereto or included therein. All suggestions, recommendations, bug-fixes, error-fixes or other communications from You to GMM regarding the Website shall, upon submission to GMM, be owned solely and exclusively by GMM. "GetMyMachine", "GetMyMachine.com", "GetMyMachine.in" and related icons and logos are registered trademarks or trademarks or service marks of GMM in various jurisdictions and are protected under applicable copyright, trademark and other proprietary rights laws. The unauthorized copying, modification, use or publication of these marks is strictly prohibited. All content on this web site is the copyright of GMM except the third party content and link to third party web site on our website.

USE OF POSTED INFORMATION

In exchange for your use of the Website, You hereby grant GMM an unlimited, perpetual, irrevocable, fully-paid, transferable, assignable, sub-licensable, worldwide license to use, reproduce, modify, publish, edit, translate, distribute, commercially exploit, repurpose, perform and display any and all Posted Information. All calls to GMM are completely confidential. However, your call may be recorded to ensure quality of service. Further, for training purpose and to ensure excellent customer service, calls from GMM may be monitored and recorded.

GMM considers itself and intended to be subject to the jurisdiction only of the Courts of Mumbai, Maharashtra, India. The parties to this Agreement hereby submit to the exclusive jurisdiction of the courts of Mumbai, Maharashtra, India.

The above mentioned terms and conditions of use and/or Agreement and the Privacy Policy constitute the entire agreement between the User(s) and GMM with respect to access to and use of the web site, superseding any prior written or oral agreements in relation to the same subject matter herein.
